The Harper Law Firm, P.C has nearly 80 years of combined experience representing clients in Colorado family law matters, including divorce, allocation of parental responsibilities (Colorado’s term for what many people still call custody and visitation), parenting time, child support, adoption, and modification of prior court orders. These matters are often emotional and complicated, and can become expensive if not handled efficiently.

Divorce in Colorado

Colorado is a “no-fault” divorce state — the only ground the court requires is that the marriage is irretrievably broken. Fault (such as an affair) generally does not need to be proven and does not typically affect property division. To file for divorce in Colorado, at least one spouse must have lived in the state for 91 days before filing, and Colorado imposes a minimum 91-day waiting period from the date the other spouse is served (or the petition is filed, if both parties join in it) before a decree can be entered.

Parental responsibilities and parenting time

Colorado replaced the old “custody and visitation” framework years ago with “allocation of parental responsibilities” and “parenting time.” Courts decide these issues based on the best interests of the child, considering factors such as each parent’s ability to encourage a positive relationship with the other parent, the child’s relationship with each parent, and each parent’s ability to meet the child’s needs.
